A change of status inside the US is not a visa. You find that out the first time you leave.

US E-2 Investor Visa: The Application Process

Part of the guide Guide to the E-2 Investor Visa for the USA

If the E-2 investor or employee is already in the US with a valid visa status, they can file directly with USCIS inside the United States for a change of status, an extension of stay or a change of employer, without leaving the country.

If the investor is outside the US, the E-2 visa does not require a petition approved in advance by USCIS. That means the investor or employee can apply for the E-2 visa in their own name, directly at a US embassy or consulate in their country of citizenship or residence. The E-2 visa can be issued for up to 5 years and renewed indefinitely, as long as the applicant continues to meet the visa requirements. The actual validity depends on the treaty between the US and the applicant's country and on the discretion of the consular officer.

Keep in mind that an approved change of status is not a visa. As soon as the person leaves the United States, for any reason, they must apply for a new E-2 visa at a US consulate before coming back. Only a US embassy or consulate can issue an E-2 visa that allows entry into the US. USCIS only grants permission to stay to people who are already in the US and cannot issue an E-2 visa for entering the United States.

You'll find everything else about the visa on our E-2 investor visa overview page, including the investment amount and the visa for spouses and children. For your specific situation, the best next step is to book a consultation.

  • The visa can be valid for up to five years and renewed indefinitely; the actual validity depends on the treaty with your country and on the consular officer.
  • An approved change of status is not a visa: every time you leave, you need an E-2 visa from a consulate.
