Public charge from September 18: the totality of circumstances is back
The final rule on the public charge test was published on July 20. It rescinds the 2022 rules and restores the totality of circumstances test. Effective September 18.
In November it appeared as a proposal in the Federal Register; now it is law. On July 20, 2026 the final rule was published that rescinds the public charge regulations from 2022. It takes effect on September 18.
That means the question of whether someone is likely to become a burden on the American government is once again what it was for decades: a discretionary decision made by a human being.
What exactly goes away
Two things, and both were limits that worked in applicants' favor.
The definition. Under the 2022 rule, someone counted as likely to become a public charge only if they were likely to become primarily dependent on the government. In the established reading, primarily meant more than half. That definition is gone.
The limit to certain benefits. Under the 2022 rule, essentially only cash assistance for income maintenance and long-term institutional care at government expense counted. That limit is gone too.
The totality of circumstances is back: age, health, family status, assets, education, skills, and whether there is a reliable affidavit of support.
Who is affected in practice
For our typical clients, not much. Entrepreneurs who arrive with their own capital, their own company and their own health insurance have never been the problem on this question.
Four groups should pay attention.
Retirees. Age and health are explicit factors. Someone who immigrates at sixty-eight, with no American income and health insurance that gets expensive with age, is in a different position from a thirty-four-year-old founder.
Family-based cases. Here the sponsor's affidavit of support matters most. Sponsors just above the income thresholds are more likely to feel the change.
Families with chronically ill members. This is where the debate is fiercest, and there is no point sugarcoating it. Health is a factor. If this is your situation, prepare for it rather than hoping nobody notices.
And anyone already in the country who has received benefits. Receiving benefits does not automatically make anyone a public charge. But the range of what may be considered is now wider.
Why health insurance decides everything here
If you take away one sentence from this article, make it this one: in the United States, solid private health insurance is not just a health matter, it is an immigration argument.
If you are insured, you clearly do not depend on the government stepping in. If you are not, you have two options when something serious happens: pay, or use a public benefit. And that second option is exactly what this is about.
Since the turn of the year this has become more expensive, because the enhanced subsidies expired and the income cap returned. So if you planned your move in the fall, take another look at your insurance now.
What it costs and how the system works is covered in Health insurance and healthcare and in US health insurance at a glance.
How a totality review works in practice
Because the term sounds so abstract, here is what actually happens. The review takes place at two points: at the consulate for an immigrant visa, and at the agency in the US for an adjustment of status.
The officer has in front of them: your form, proof of income and assets, a sponsor's affidavit of support if applicable, the medical exam, your age, your family status, your education. They are not doing a math problem, they are forming a judgment.
A forty-two-year-old engineer with $200,000 in the bank, insurance and an employment contract is through in seconds. A seventy-one-year-old widow with no American income, sponsored by her daughter and with a preexisting condition, is not. Both cases are approved regularly, but the second needs a file that anticipates the doubts.
That is where the work lies: not hiding anything, but answering the obvious question before it is asked.
What belongs in a strong file
Liquidity, not just assets. Several months of bank statements carry more weight than a property valuation, because they show what someone lives on.
Insurance with real coverage. Not a travel policy, not a catastrophic plan with a five-figure deductible.
A plausible income picture after the move. For entrepreneurs: the company, its contracts, its order book. For retirees: the pension, the portfolio, the rental income, with proof that it can actually flow.
And honesty. If you hold something back on this question, you do not risk a denial, you risk a finding of misrepresentation, and in this system that is the far more serious category.
The timeline
The rule takes effect on September 18, 2026. Decisions issued before that date are made under the old rules; decisions after it, under the new ones.
For anyone with a pending case, that means completeness is worth more than usual right now. Every request for evidence costs months, and here months can decide which rules apply.
If you want your file reviewed before it goes into a case, talk to Mount Bonnell Advisors in Austin, Texas. The bigger picture is in our US visa and green card guide.
What this says about the year
Formally, this rule is a rollback that restores a state of affairs that held for decades under administrations of both parties. So it is not the break some headlines make it out to be.
What really changes is predictability. A rule with a number was unusual in this area of law. Its removal takes us back to a system in which people decide.
And whatever the criticism, that is the basic rule of all American immigration law: submit a clean, complete, consistent file and you get through. Leave gaps and hope nobody asks, and you have lost before the interview begins.
What this means for pending cases
If you have a case pending today, do three things.
Check for completeness. Every request for evidence costs months, and here months decide which rules apply.
Update your insurance position. If you took out coverage in the fall, check whether the policy still does what it should and whether it is still affordable. A lot has shifted since the turn of the year.
And bring your proof of income and assets up to date. Bank statements older than six months convince nobody.
A look at the year
This rule is one of many in a year in which American immigration law moved almost every month. What links it to the others is a pattern.
Fewer fixed numbers, more discretion. Fewer automatic extensions, more recurring reviews. Fewer exceptions, more fees.
For someone who is well prepared, little changes. For someone who relies on leniency, everything changes.
That is the uncomfortable summary of this year, and it applies to almost every area we have written about here.
And the question behind it
Whether this country wants to take in people who might need it. This year's answer: less than before, and far less than in the decades before that.
You can see that as right. A social safety net that is thin to begin with cannot carry unlimited strain, and the United States has never pretended to be a welfare state.
You can also see it as a break with the country's own history. Almost none of the people who came through Ellis Island in the 19th century would have met today's criteria.
For you as a European entrepreneur, this debate is above all a sign of where you stand in this system. You belong to the group this country explicitly wants: qualified, self-funded, with a business behind you.
That is an advantage, and you should use it, without forgetting that other people in the same processes are being treated much more harshly right now.
The order we recommend
If you have an immigration case ahead of you, follow this order, whichever category you are coming in under.
First, health insurance. It is your most expensive ongoing cost and, at the same time, your strongest argument on the public charge question. Once you have it sorted, the hardest part is behind you.
Second, liquidity. Not wealth on paper, but available funds in an account, documented over several months.
Third, your income picture after the move. What will you live on over there, and how can anyone see that?
Only then the forms. If you start with the forms, you realize halfway through that the substance is missing, and you have to start over.
Follow this and you have answered the public charge question in your case before anyone even asks it. In a system with broad discretion, that is the only reliable strategy.
What I advise clients in this situation
First: take the question seriously, even if you are sure it doesn't apply to you. Sorting it out takes twenty minutes, and the alternative is a request for evidence that drags your case out by months.
Second: build your documents so they convince without explanation. An officer with broad discretion goes by what is in front of him, not by what he would have to ask for.
Third: choose the route that fits your situation. If you come through your own company and your own capital, you are structurally better placed on this whole question than someone who comes through a sponsor's guarantee. That is why the E-2 and the L-1 are the more robust routes for European entrepreneurs.
The difference between a number and a judgment
A rule with a percentage threshold is strict, but predictable. You can check whether you fall below it, plan around it and, if in doubt, point to it.
A totality-of-circumstances test is softer and therefore more powerful. It lets an officer wave you through even though your numbers are mediocre, because the overall picture is convincing. And it lets him deny you even though your numbers are fine, because something else bothers him.
Both happen, and both are allowed. That is exactly why preparation decides the outcome in this system.
